Samsung fails to ban iPhone in Netherlands

The dispute that is running between two major tech companies which are Samsung and Apple never seems to come to an end. Previously, Apple had managed to get one of Samsung’s device which is the Samsung Galaxy Tab to be banned in Germany due to its similarity with the iPad. This results in Samsung manufacturing an N version of the device which was legal to be sold in the company. Since then, the court disputes between the two companies have been set in a few countries in the European Union.

Recently, Samsung managed to get a court dispute in Netherlands for the ban of iPhone and iPad devices in the country. This is because the iPhone uses a 3G patent which is held by Samsung and a license was not given to Apple to use this particular patent. However, the Dutch court had rejected the bid to ban these devices and as a result, Samsung lost its legal battle in the Netherlands.

Nevertheless, the Dutch court had started that even though Samsung cannot claim damages from Apple’s Qualcomm based chips, it can however, claim damages from devices that use the Intel chips instead. It is yet to be seen whether the company will take action based on the court’s suggestion.
